Terms of Service

1. Acceptance of Terms

By accessing or using ngsrv (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms; material changes will be communicated in-product or by email at least 30 days before they take effect, and your continued use after that constitutes acceptance.

2. Description of Service

ngsrv is a tunneling and edge service. We accept HTTP and TCP traffic on a public hostname (a subdomain we provide or a domain you bring), apply the security policies you configure (IP allow/deny, geo restriction, rate limiting, WAF, header authentication, time-based access, mTLS), record per-request metadata for your dashboard and billing, and forward the traffic to your origin via the ngsrv CLI. The Service also includes the dashboard, the CLI, and the related APIs. The exact feature set available to you depends on your plan.

3. Account Registration and Security

3.1 Account Creation

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 Account Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

3.3 Account Security

You must immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.

4. Acceptable Use Policy

You agree not to use the Service, and not to allow anyone else to use it through your account, to:

  • Violate applicable law or regulation.
  • Infringe the intellectual property rights of others.
  • Transmit malware or other malicious code.
  • Phish, spam, defraud, or impersonate any person or organization.
  • Host or distribute illegal content, including child sexual abuse material, or pirated software.
  • Launch or relay denial-of-service attacks, or otherwise intentionally degrade other services.
  • Attempt to gain unauthorized access to ngsrv, our infrastructure, or any other system.
  • Run cryptocurrency mining workloads without our prior written permission.
  • Use the Service as a generic open proxy or open relay.
  • Circumvent plan limits, security policies, or audit controls.
  • Resell, sub-license, or repackage the Service without our written permission.

We may suspend or terminate access immediately if we reasonably believe you are violating this section, and we cooperate with valid legal process.

5. Service Limitations and Fair Use

5.1 Plan limits

Your account is subject to the limits of your current plan — including the number of concurrent tunnels, custom domains, team members, API tokens, security policies, monthly bandwidth, and request volume. On hard-limit plans (Free, Pro), reaching a limit blocks further creation of that resource until you upgrade. On Pay-as-you-go plans, exceeding a limit may trigger automatic add-on charges in accordance with your spending cap.

5.2 Fair use

We may throttle, suspend, or terminate accounts whose usage causes harm to other users or the Service — even if it is technically within stated plan limits — including sustained traffic patterns that look like abuse, scraping infrastructure, or attempts to use the Service primarily as bulk egress.

5.3 Service availability

We work hard to keep the Service available, but we do not guarantee uninterrupted service. We may perform maintenance, upgrades, or emergency interventions that temporarily affect availability.

6. Logging, Full Capture, and Your Content

6.1 What we log by default

By default, the edge logs per-request metadata for traffic routed through your tunnels — including timestamp, method, path, status, sizes, client IP and coarse location, and a bounded set of HTTP headers required for routing, debugging, and security enforcement. Sensitive headers (such as Authorization and Cookie) are redacted. Request and response bodies are not captured in the default mode.

6.2 Full Capture (opt-in)

Paid teams may enable a feature called "Full Capture" from the Team Settings page, which extends per-request logs to include the full request and response body (truncated at 1 MB each) for the team's traffic. Only the team owner can enable Full Capture, and enabling it is recorded as an explicit consent event with the consenting user's ID and a timestamp. The team owner is responsible for ensuring this is lawful for the data their service handles, and for telling their end-users about it where required.

6.3 Retention

Logs (and any Full Capture bodies they contain) are deleted automatically when their retention window expires. Retention is set per plan and is documented in our Privacy Policy.

6.4 Your content

You retain all rights to traffic and configuration you push through the Service. You grant us only the rights necessary to route, store, and display that data to you for the purposes described in these Terms and the Privacy Policy.

7. Payment and Billing

7.1 Subscription Fees

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

7.2 Payment Processing

Payments are handled by a PCI-compliant payment processor. You authorize us to charge your payment method for all fees incurred. You must provide current, complete, and accurate billing information.

7.3 Price Changes

We reserve the right to change our pricing at any time. Price changes will be communicated at least 30 days in advance and will apply at your next billing cycle.

7.4 Failed Payments

If payment fails, we may suspend your account until payment is received. Continued payment failure may result in account termination and data deletion.

7.5 Usage-Based Billing

Pay-as-you-go plans include usage-based charges for bandwidth, requests, and security policies. You are responsible for all charges incurred under your account, subject to any spending caps you configure.

8. Intellectual Property

8.1 Our rights

The Service — including the software, the dashboard, the CLI, designs, text, graphics, and logos — is owned by ngsrv and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service except as expressly permitted by us in writing or by an open-source license we publish.

8.2 Feedback

Any feedback, suggestions, or ideas you give us about the Service may be used by us without restriction or compensation to you.

9. Termination

9.1 Termination by you

You may terminate your account at any time through your account settings. Termination does not entitle you to a refund of any fees already paid.

9.2 Termination by us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. We reserve the right to refuse service to anyone.

9.3 Effect of termination

Upon termination, your right to use the Service immediately ceases. We may delete your data within 30 days of termination. Sections of these Terms that by their nature should survive termination will survive.

10. Disclaimers and Limitations of Liability

10.1 Service provided "as is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10.2 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NGSRV LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10.3 No liability for user content

We are not responsible for any content transmitted through the Service by users. You use the Service at your own risk and are solely responsible for your content and activities.

11. Indemnification

You agree to indemnify, defend, and hold harmless ngsrv LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any rights of another party, or (d) your content.

12. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. If you use the Service to handle personal data of your end-users, you are the controller for that data and are responsible for meeting any disclosure, lawful-basis, and transfer obligations applicable to it.

13. Dispute Resolution

13.1 Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ngsrv LLC is established, without regard to conflict of law principles.

13.2 Arbitration

Any dispute arising out of or related to these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13.3 Informal resolution

Before initiating arbitration, you agree to first contact us to attempt to resolve the dispute informally.

14. General Provisions

14.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ngsrv regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

14.5 Force majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
